In accordance with art. 52 of the Legislative Decree 6 September 2005 n. 206 (the "Codedel Consumo "), you have the right to withdraw from the signed contract DiamonDiamonD S.R.L. (the "Seller") without any penalty and without having to provide any reason, within 14 days from the day you received the products purchased on DIAMSAFESTORE.com.
In compliance in art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your choice, one of the following mode:
a) broadcastonline to the Seller of the Form that you find on the DIAMSAFESTORE.com website, completed in full; in this case, the Vendor will send you confirmation by e-mail of receipt of the declaration of withdrawal;
b) send by middlepost an explicit statement of your decision to withdraw from the contract. In that case your statement will need to be sent to DIAMSAFE SRL, via della scrofa, 73 - 00186 - Rome (RM).
It is understood that, in such cases, the burden of proving the correct andtimely exercise of the right of withdrawal.
In accordance with art. 57 of the Consumer Code, once the withdrawal from the contract, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated to the Seller your decision to withdraw from the contract.
In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded inin the event that you have purchased customized products or sealed goods that do not lend themselves to being returned for reasons hygienic or related to health protection and were opened after delivery.
1. Exclusion of the right of withdrawal incompliance with Article 59 of the Consumer Code. Conditions for exercising the right of withdrawal in accordance in art. 52 of the Consumer Code.
Pursuant to Article 59, paragraph 1, lett. c), of the Consumer Code, “The right towithdrawal referred to in articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to […] the supply of goods made to measure or clearly personalized ”.
DIAMSAFESTORE.com through the combination of diamond and blister made with unique recognition through the DIAMSAFE proprietary technology, sells a customized product for which the law excludes the right of withdrawal.
By virtue of the above, the right of withdrawal is exercisable and correctly exercised if the following conditions are fully met:
a. the right of withdrawal must be duly exercised within fourteen (14) days from receipt of the products;
b. the product does not must have been tampered with, i.e. the blister must not have been tampered with and the contents must not be replaced;
c. products must be returned in their original packaging and must not show signs of abrasion or alteration;
d. the returned products must be delivered to the forwarder within fourteen (14) days from when you notified the Seller your decision to withdraw from the contract;
e. the products do not must be damaged.
If you have complied with all the required conditions, the Seller, in accordance with art.56 of the Consumer Code, will reimburse you in full the price of the products purchased, remaining at your expense only of the return, i.e. those for returning the purchased products to the Seller. It is understood that, in compliance with art. 56, paragraph2, of the Consumer Code, any additional costs incurred by you for choosing a type of different and / or faster shipping and delivery than the standard one.
2. Method of returning products to the Seller
You will have to entrust the delivery to an authorized courier and pay the costs of the return, remaining your responsibility in case of loss or damage to products during transport.
3. Conformity checks of returned products
You will be contacted if your return cannot be accepted because it does not comply with the conditions referred to in the previous paragraph.
In accordance with art. 57, paragraph 2, of the Consumer Code, you will be responsible for decrease in value of returned products, resulting from use other than that necessary in order to allow you toascertain the nature, characteristics and functioning of the products themselves.
In this case, a percentage equal to the estimated decrease in value of the products and in any case between 10 and 90 percent of the sums paid by you to the Seller for the purchase of returned products, according to what will be specifically communicated to you, by e-mail, by the Seller. Within fourteen (14) days from sending the e-mail with which you will be notified of the amount deducted from the refund, you can choose toto get back, at your expense, the products in the state in which they were returned to the Seller, notifying the Seller there of, according to the modalities that will be communicated to you. Otherwise, the Seller may keep the products and a corresponding amount the percentage deducted from the refund.
4. Times and methods ofrefund
After theSeller will have received your return and checked that all the requirements have been met, you will receive a confirmation e-mail of return acceptance and the Seller will proceed with the full refund, or, if the existence of a decrease in the value of the returned products, you will receive an e-mail in which you will be informed of the amount deducted to refund deduction title and the Seller will refund the amount due. Whatever the mode of payment used by you among those available, the refund is activated by the Seller as soon as possible and in any case within fourteen (14) days from the date on which you became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal took place in compliance with the above conditions.
The actual time for crediting or returning the sums you paid for the purchase of the products depends on the payment methods used:
- purchase via PayPal: the refund will be made to your PayPal account and will be immediately visible. The actual refund on the credit card from your PayPal account depends on the institution that issued the paper;
5. Consumer Code
These Conditions for exercising the right of withdrawal, forming part integral to the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
